Geachte confrère,

Namens cliënten, TMG Online Media B.V. en TMG Landelijke Media B.V. (hierna: “TMG”), vraag ik uw aandacht voor het volgende.

Het vonnis van de Voorzieningenrechter van de Rechtbank Amsterdam d.d. 5 juli jl. is op maandag 8 juli jl. om 17.10 uur betekend aan uw cliënt de heer Kat (zie bijlage). Ingevolge het gebod zoals door de Voorzieningenrechter opgelegd in r.o. 5.1, had Kat dus uiterlijk dinsdag 9 juli jl. om 17.10 uur de weergave van de website www.telegraaf.nl via de domeinnaam www.pedograaf.nl en /of www.depedograaf.nl moeten staken en gestaakt houden op straffe van het verbeuren van dwangsommen.

TMG heeft geconstateerd dat Kat niet heeft voldaan aan het door de Voorzieningenrechter opgelegde verbod en dat de website van de Telegraaf thans nog steeds via de domeinnaam www.depedograaf.nl wordt weergegeven (zie bijlage). Kat verbeurt zodoende vanaf heden € 1.000,- per dag dat hij het gebod niet nakomt en TMG zal niet schromen het totaal aan verbeurde dwangsommen op te eisen als Kat niet per direct het gebod nakomt.

Hierbij verzoek ik uw cliënt dan ook (nogmaals) om de weergave van de website van de telegraaf via de domeinnaam www.depedograaf.nl per direct te staken en gestaakt te houden.
