DUBLINCCThe following happened in the Criminal Courts on 23-1 starting 13:00: After the jury left the courtroom Judge Hunt drew the attention on me. He said there was a man in this room from the website KillingIrishWomen, Micha Kat. The prosecutor mr. Guerin identified me for the judge and I rose. The judge approached me quite aggresively and pointed out that there was something wrong with me and my website. I didn’t really understand what was the problem. In the meantime also the defense seemed exited and angry at me. Printouts from my website were produced and circulated, they also gave me a copy. I was very intimidated and at unease so I don’t remember exacty what was said at this point. I asked the Judge ‘what is the problem?’ but he said I would get opportunity to say things later. I heard someone say thay my website stated that not mr, Dwyer was the killer of Elaine, but ‘a member of An Garda Siochana’. They hereby mean Paul Condon against whom five or six complaints have been filed with GSOC. Then it was lunchtime and the Judge said that during this period I had to ‘consider my legal position’. He said I broke the Irish law because I would have said who was the killer of Elaine. He said it was only allowed in Ireland to report om what happend in the courtroom. He said the jury could be influenced. He then said that I had to conform to certain rulings of his, if not, this could have ‘consequences for my liberty’. Then he placed me in ‘Garda custody’. Then everyone left the courtroom and I stayed behind surrounded by three Gardai. When I wanted to make a phonecall, they took my phone. I asked: “Am I under arrest now?” They said no, they were ‘following orders from the judge’.

At 14:00 the room filled up again. I had prepared a list of questions. I felt much stronger and more self-assured now and in control. I pointed out to the Judge that he himself had advised the jury strongly NOT to read the media; they are not obliged to read my website so what is the problem? I asked. Then the Judge said -strangely- “I will take care that they don’t read your website’. Again it was pointed out that I break Irish law. I asked what law specifically, what articles. Then the Judge said he could provide ‘two verdicts’. I said that the media are strongly regulated by European Law but this was denied by the judge. The judge said that there were ‘things’ written on the website that were in breach with Irish law. I replied the Irish Constitution guarantees freedom of speech. I asked the judge for examples what parts of the website he ment but he couldn’t or wouldn’t give those exemples. The Judge said I was very wellcome to report on the trial, but that I had to behave ‘like all the other Irish journalists’. I said this could not be the case since I am Dutch. I said: “When you have a Chinese journalist in the room he will behave diiferently again, not to mention a reporter from Afghanistan”. The judge adivised me to ‘study the Irish law’. Het said that during the weekend I had to again ‘consider my position’ and he ordered me back on monday in the Court to ‘report’. I took my belongings, but the judge said I was ‘very wellcome to stay’. I said I am a law obiding citizen and thanked him for his advise. I asked him also if he could give me advise on how and where to get legal assistance, but this he declined.
